Crime And Punishment
Rafe and Sami are at her place. Rafe asks where she was. Sami dodges the question. Rafe says he has something to tell her but a phone call interrupts. Rafe goes off to take the call. Sami flashes back to EJ's assurances, "There is something I have to tell you too, Rafe."
EJ paces in the rumpus room and talks on the phone. He neither believes nor likes the news he's getting, so he rushes out.
Nicole visits with her attorney in her jail cell. She tells him she's pleading guilty. "You could spend the rest of your life in jail," he says, "It is no disgrace to plead 'diminished capacity' and I think that's what you should do."
"What does 'diminished capacity' mean," asks Nicole.
"It means you're just like everyone else in this wacky town," says the lawyer.
Chad brings coffee to Gabi at the Java Café. Mia walks in as Gabi and Chad talk about school.
Troy sits across the room, watches and waits.
Mr. Sleazy slithers into the pub. Arianna takes inventory and boogies to salsa music in blissful oblivion.
Sami gives herself a pep talk as Rafe comes back. She starts to tell him everything but in true DOOL style, EJ shushes her because his news is more important than her news. He tells her the FBI has reinstated him, "The guy who iced me retired."
"You mean the smart one," asks Sami.
"Right," says Rafe, "And he was replaced by a guy who thinks I do a pretty good job."
"You mean the dumb one," asks Sami.
"Right," says Rafe, "And this new guy is impressed with the work I've done figuring out the switcheroo. He wants me to stay on the case."
Sami is just giddified. Then Rafe tells her Nicole's sentencing hearing is today.Nathan and Stephanie bump into each other at the nurses' station. Stephanie mentions his arrest, "What did Maggie think of that?"
"Maggie," asks Nathan, "I managed to stay in the will."
Stephanie morphs into ice-woman, "I'm not that forgiving."
Phillip carries Melanie across the threshold at the DiMera mansion. Melanie wonders why they are doing this since they aren't married. Phillip wants to do something else even though they aren't married.
Rafe and Sami are all dressed up for court as Will walks in. They tell him where they are going and also drop the news about Rafe's reinstatement. Will asks to go and heads in to get ready. Rafe tells Sami about Brady's visit and Nicole's depression. "She deserves it," says St. Sami.
"She sure does," says Rafe, "You don't' lie to the people you love. The blood drains from Sami's face.
Nicole's lawyer tries again. Nicole says no again, "I am guilty. Whatever the judge decides is fine. I don't deserve mercy."
"I'll ask you about that again in about ten years," says the lawyer, "After you celebrate a decade of being Big Bertha's bitch in Statesville."
"I'm not going to forgive and forget," says Stephanie.
Nathan defends himself, "Hey, Phillip threw the first punch."
"Are you that dense and thoughtless," asks Stephanie
"Oh, no," says Nathan, "That only scratches the surface on my ability to be dense and thoughtless."
Stephanie goes in for the kill, "You asked me on a New Year's Eve date and ended up fighting over Melanie!"
Nathan grovels, "I'm sorry."
Phillip tells Melanie they're taking the Titan jet to Vegas, so they have time for some pre-flight maneuvers. Melanie says she's too excited and wants to go now.
Mr. Sleazy stands in the pub ready to strike his prey. The Mighty Mouse theme plays in the background as Brady walks in, "Hey, what are you doing here, man?"
Chad gives Gabi a warmup on the house. She says she'll be right back, gets up and runs off. Mia walks up. "Hey," says Chad, "How's it going?"
"It's not a good day," says Mia, "Because they are sentencing Nicole today and I have to testify."
Monkey see, monkey do.
Chad wants to testify, too.
Chad walks off. Gabi comes up to Mia and asks, "What's up with Chad?"
"Come to the courthouse and you'll find out," says Mia. Gabi agrees to go and walks off. Mia chuckles.

Nathan and Stephanie fumble around each other and share an uncomfortable conversation. Nathan says, "I'm making some major changes and they start with you. I either have to start dating you or buy a new doormat."
Melanie gripes about what Phillip is packing. He wonders if this is a preview of married life. No, Phillip, this is bliss compared to married life. Once you're hitched to Melanie, they will have to define a whole new circle of hell to toss you into. He smooches her and Melanie changes her mind about heading for the jet.
Mr. Sleazy says he just came in for a cup of coffee. "The sign on the door says the pub is closed," says Brady, "What part of 'closed' confused you?"
"What can I say," says Mr. Sleazy, "I haven't had my coffee yet." He leaves.
Brady tells Arianna about Nicole's sentencing. Arianna stews, "And, of course, you want to (say it with her) be there for her, right?"
"I should be," says Brady. He invites her to go with him but she declines.
Daddy DA tells Chad he doesn't have to testify. He says he wants Chad to keep his name out of things. Chad insists, "It's gonna happen. Get used to it." When normal people talk back to their dads like that they carry the scars for all the days of their lives.
Meanwhile, Gabi turns to Mia and asks, "This woman is being sentenced for kidnapping. Why would Chad have to testify?"
"Just listen," says the once-innocent, now conniving and spiteful Mia.
Rafe, Sami and EJ are seated together in the back of the courtroom. Rafe gets a call and leaves. Sami turns to EJ and asks if he got the money. He says he's working on it and makes sure Sami hasn't told Rafe.
The somewhat Honorable Judge David Goldberg comes in and gets things started. The DA immediately stands and asks for punishment to the fullest extent of the law. Nicole's lawyer objects. The judge don' need no stinkin' objections. He wants facts and testimony and starts by calling EJ to the stand.
Arianna softens and tells Brady she will stop by the hearing after she finishes the inventory. Brady says he doesn't like leaving her alone, but he goes. Arianna flashes back to their argument on the pier about Brady helping Nicole.
Troy and Sleazy walk outside and argue. Troy says he wants the job done even if it means whacking both Arianna and Brady. Mr. Sleazy goes to work.
EJ is on the stand. He paints a bleak picture of Nicole and all her lies. We fade to Sami on the stand piling on. She talks about how Nicole switched babies and she came to love Grace, "I will never forget our sweet amazing Grace and I would give anything to have her back."
Mia gets on the stand and tells her story. Chad testifies. Gabi sits in the back and begins to get a clue about Chad and Mia. Back to EJ... Sami... Mia... EJ again...
Sami again... She trashes Nicole like a pile of dog poo on the living room carpet and talks about how they lost Sydney because of her, "We don't know if we'll ever see her again and it's all because of Nicole."
Nathan tells Stephanie he forgot what he really wanted. Stephanie asks, "Which is..."
Melanie and Phillip have pre-consummated their marriage. They finally decide they'd better head for Vegas. Phillip gets up. Melanie sleeps... Melanie and dreams of making love... We see body parts and a hand groping. We pan up... up... up...

"Forget the jet," says Nathan, "Let's stay in bed all day. How's that sound?"
Lost in ecstasy, Melanie whispers, "Like heaven."

Troy tells Arianna the shipment will be late again. She grumbles about it and shows him out. She goes back to work but decides to head for the court instead.

Phillip stands at the foot of the bed, "Me too," Mel pops out of it and says she has a favor to ask.
Brady testifies, "I think on some level Nicole went insane."
"From the testimony I've heard," says Judge Goldberg, "I'd say she went right past insane to the level of total wackadoodle."
Arianna walks in and listens. Brady continues and says he thinks Nicole really thought in her heart she gave birth to Sydney, "There is no sentence you could give that would be worse than what she's going through."
"Wanna bet," asks the judge.
"I ask that you be kind," says Brady, "She deserves mercy." Out in the peanut gallery, Sami huffs her disapproval.
Nicole goes to the stand. The judge reminds her she doesn't have to testify. Nicole says she wants to, "I want everyone to know there is no excuse for what I did. It was terrible and unforgivable. Every choice I made was wrong. I deserve the worst sentence you can give, Your Honor. All I care about is Sydney and bringing her home. I'm sorry. BBAAAWWWLLLLL..."
Stephanie asks, "So your Melanie chasing fantasy is over? Now what?"
"That depends on you," says Nathan, "If you give second chances you know where to find me." He walks away. Stephanie stares.
Melanie asks a favor, "I was hoping we could honeymoon in Europe. I want to show you where I lived and partied and got guys to cough up money." Now there's the basis for a great start to the marriage. If Phillip winds up in jail over a little spat about her, what's going to happen when he meets and greets all her johns... uh... marks... uh... former acquaintances?
That doesn't scare me," says the dimwit.

What if this woman would receive the same punishment for her crimes as you have had for yours — that is... NOTHING! With you, crime and punishment don't seem to go hand-in-hand."
Phillip stops by the hospital and finds Stephanie. He announces he's there to tell people Melanie won't be around for a while. He tells her about the upcoming honeymoon. He also asks about Nathan and Stephanie says his fight with Phillip knocked Melanie out of his system, "He decided he needed someone more real."

Nathan finds Melanie in an office filling out paperwork. She tells him about the long honeymoon, which means nursing school is kaput. The medical profession is safe.
Gabi storms into the Java Café and tells Chad she would have appreciated a heads-up about his and Mia's baby. Evil Mia watches and chuckles.

The judge says, "I feel for you, Ms. Brady, but I have gone through your records and I see you have a penchant for custody battles. I also see you lied in this matter yourself. I am ready to render a verdict. My decision is as follows..."

Arianna is not gonna be happy that Brady testified for Nicole. How did the DOOL writers manage to put yet again, all three Hernandez family members in this episode??? We didn't see Maggie, Bo, Hope, or Justin, Vivienne, Victor... yikes!

The guy isn’t just dumb. He’s certifiably stupid. Although the DOOL writers have not been crystal clear about the reasons the Rafemeister was dumped by the FBI, it probably had something to do with his unprofessional conduct while “protecting” Sami on the taxpayers’ dime or that he’s boinking her. Heck, he’s so good in the boinking department that he’s gotta be a devotee of the Kama Sutra. Sorry, I couldn’t help myself. Anyway since Rafe is shacking up with the mother of the kidnapped baby, there is no way he should have any involvement in the kidnapping investigation. He can’t maintain any objectivity and could put the lives of others in danger. Does the new guy remember Hilda?

How typical is this?
Courtroom drama – as if!!! The trial was about Nicole kidnapping Sydney. Neither EJ’s nor Sami’s past transgressions should have any relevance in Nicole’s sentencing. It’s pretty obvious that Nicole is more than a few sandwiches short of a picnic but why is Brady pointing that out to the judge? The hot shot attorney that Brady hired for Nicole should have brought in a psychiatrist to consult with Nicole and then serve as an expert witness. Get with it writers. It’s not like the DOOL viewers haven’t seen their fair share of Perry Mason movies. Scott Turow anyone? Geez!

Maybe not, but it sure is nice that somebody on this show is finally pointing out to the holier-than-thou EJ and Scami that they have not always been the pillars of virtue in the legal (or any other) sense. I may actually have to record this episode and watch it to see the look on their faces when the judge tells them off - assuming that Galen's lack of acting skills have not rubbed off on them and they're still capable of displaying emotion on the screen.

Berg, I'm with you 110%! Would somebody tell TPTB that "All Hernandez all the time" is not going to win them any new viewers - especially when 1/3 of them can't act his way out of a wet paper bag and 1/3 of them (Arianna) is really not that attractive.

If they wanted to remind folks about Mickey before he takes the big dirt nap they could've had him come back and do these few court scenes. But then that would've involved paying the actor and they're too cheap for that.
Everyone can see what's coming with the Nathanie/Mellip storyline (Nathanie getting heavily involved and then Melanie being jealous and probably breaking them up, etc. etc.) So just get on with it or drop it already!! OK, rant over.

It almost looked like Rafe was finishing putting away the Christmas decorations, tree included. First he put all of them up and now taking them down. Whatta guy!! Do you think he'd come over and help me with ours?
I noticed yesterday and today they didn't have the trivia segments at the 20 minute commercial breaks. I wonder if they gave those up in the new year? I kind of liked those. I suppose NBC figured doing away with them gives them 15 seconds more for their plugs.

It was not your computer. Equipment failures abound at the Prevuze Compound and today I only got a black and white feed. The show was in color. I have found and fixed the issue and tomorrow everything should be back to living color.
Prevuze, I'm very happy you resolved your issues. But, awww, shux, I kinda liked the film noir black and white look
